HIPAA & Compliance Statement
Enlightened Minds Mental Health is committed to protecting your privacy and ensuring compliance with the Health Insurance Portability and Accountability Act of 1996 (HIPAA). This statement explains how we safeguard your health information and which communication methods are considered secure.
Our Responsibilities Under HIPAA
As a mental health provider, we are required by federal law to:
- Maintain the confidentiality of your protected health information (PHI).
- Provide you with a Notice of Privacy Practices at the start of care.
- Disclose how your PHI may be used for treatment, payment, or healthcare operations.
- Obtain written authorization for uses not otherwise permitted by law.
Secure vs. Non-Secure Communication
Secure Methods: We use a HIPAA-compliant client portal and encrypted telehealth platform for sharing sensitive information, scheduling, and therapy sessions.
Non-Secure Methods: Email, text messaging, and website contact forms are not HIPAA-compliant. These should be used only for basic scheduling or administrative requests and should never include personal health information.
Client Acknowledgment
By contacting us via non-secure methods such as email or the website form, you acknowledge and accept the potential privacy risks. For confidential matters, always use secure communication channels provided by our practice.
Data Storage & Security
Your health records are stored in a secure, encrypted system with restricted access. We implement administrative, technical, and physical safeguards to protect your data from unauthorized use or disclosure.
Your Rights
Under HIPAA, you have the right to:
- Access and request a copy of your health records.
- Request corrections to inaccurate information.
- Limit certain uses or disclosures of your PHI.
- File a complaint if you believe your privacy rights have been violated.
